The following
promotion is intended for viewing in the United States and on US
military installations worldwide and shall only be construed
according to U.S. law. YOU MUST BE 21 OR OLDER IN THE UNITED
STATES OR LEGAL DRINKING AGE OVERSEAS TO BE IN THIS SITE AND TO
PLAY.
1. SWEEPSTAKES SIGN-UP
PERIOD. 1 April - 31 Dec 2009
2. SCHEDULE. Winners will be
determined and prizes will be awarded as follows: Eligible patrons
must enter by 24:00 hours Central time the Thursday prior to the
drawing to be held on the following specified dates. A total of
480 prize drawings will be awarded during the
sweepstakes period of 1 April to 31 Dec 2009. Each week ten (10) prize winners will be awarded commemorative Pepsi T-shirts,
hats and/or Pingo Calling Cards. In addition, all entries submitted during
this sweepstakes period will be awarded free songs, sung by Matt
Steel, recording Artist. Two (2) grand prizes winners will
receive four (4) tickets to each of the selected NASCAR Races, to
include the Pepsi 500 in Southern California, on October 11, 2009
and the AMP Energy 500 in Talladega on November 1st, 2009.
Grand Prize winners will be notified as per section six (6) Prizes
by the following dates: September 11, 2009 and October 1, 2009
respectively.

4. ELIGIBILITY. Sweepstakes is
offered electronically via the Internet to all persons who are
Military service-members, dependents, Department of Defense
employees, and/or authorized patrons of military exchanges and
commissaries in the USA and on US Military Bases overseas, for the
duration of the Sweepstakes, who are 21 years of age or older at
the time of entry and who have Internet access with a valid e-mail
address as of 1 January 2009. Employees and the immediate families
of SATO travel, Pepsi Cola, NASCAR and/or Volvo, including its
affiliates, parent company, subsidiaries and wholesale
distributors, advertising and promotion agencies and all retail
licensees are ineligible. To be eligible to win a prize, entries
must be received by email or via mail in the format designated
below. Void where prohibited. All federal, provincial, states and
local laws and regulations apply. Certain black out dates and
other restrictions may apply, as determined by the sponsor.
By entering said contest, registrant agrees to the terms and
conditions of this sweepstakes and agrees to receive updates and
sponsor changes to said sweepstakes. Taxes on prizes, if any, are the
responsibilities of individual winners. Only one entry per person
per day.
5. HOW TO ENTER. Enter www.MilitaryPartners.com
web site and click on Military
Partner’s Sweepstakes -- “You Could Win Big on the Web”
banner ad. Completely fill in the entry form and submit it. All
materials become the property of the Sponsors and none will be
returned. Entrant's e-mail address, name and standing may be
listed on the MilitaryPartners’ web site. Winners may be
required to provide Sponsors with proof that they are authorized
patrons of military exchanges and commissaries and if submitted by
email, that they are the account holders of the e-mail address
associated with the winning entries.
As alternate means of entry,
participants may submit their entry by mail. Hand print your name,
unit address or complete mailing address, email account, civilian
phone number, age and service on a 3"x5" index card and
mail to: Partnership Marketing, Building 4466 W. Pine, St. Louis, Missouri, 63108, received by
midnight each Thursday for the duration of the sweepstakes, to be
randomly chosen from all eligible entrants the following Friday,
at noon Central time. To be eligible for the Sweepstakes, entries must be in
on above designated dates. Each entry must be mailed in a separate
envelope. No mechanically reproduced or photocopied entries
permitted. All materials submitted become the property of
Partnership Marketing, Inc. and none will be returned.
6. PRIZES. 480 commemorative
Pepsi T-shirts, hats and/or Pingo Calling Cards will be randomly awarded
paying tribute to our Armed Forces. Matt Steel's special tribute
to our troops and their families is offered to all eligible
entries. Winners are
selected at random drawing from all of our participants. Estimated retail
value is approximately $10,000 for all prizes combined (including
360 commemorative Pepsi T-shirts/Polos, 120 hats and 7,500 free
song downloads) Odds of winning depend on the number of eligible participants. The
decisions of the judges are final in all matters relating to this
sweepstakes. The two grand prize winners, will be awarded four
tickets to each of the NASCAR series events or the Pepsi 500
in Southern California, on August 31, 2009 and the AMP Energy 500
in Talladega on October 5th, 2009. Total ticket value is $250.00
for each grand stand ticket, or a total of $2,000 for the 8
tickets. Travel arrangements and accommodations if any will
be as the expense of the winners.
7. ALL PRIZES WILL BE AWARDED.
All prizes are awarded "AS IS" and WITHOUT WARRANTY OF
ANY KIND, expressed or implied (including, without limitation, any
implied warranty of merchantability or fitness for a particular
purpose.) No substitution of prizes will be permitted except by
sponsor who may substitute a prize of equal or greater value if
advertised prize becomes unavailable. Prizes are non-transferable
and may not be redeemed for cash. NASCAR Grand Prize winners must
sign an affidavit and photo release form to include their
information in press releases. Further, the tickets are
non-transferable and must be attended by the prize winner
notified, along with three of his/her designees. The tickets
are awarded as is and no refund or alternate date of event will be
permitted to exchange the tickets for. Grand prize winners,
if unable to attend, will forfeit the tickets to another qualified
winner, who will be able to attend the event. Tickets are
non-refundable, non-transferable and should winner not be able to
accept the tickets, non-negotiable.
8. WINNER NOTIFICATION.
Prizewinners will be notified by e-mail and if unreachable by
electronic mail and/or phone, than by regular mail within approximately
seven (7) days after the date winners are determined. Acceptance
of prize offered constitutes permission to use winner's name,
biographical Information, and/or likeness for purposes of
advertising and promotion without further Compensation as
permitted by law. By participating, participants agree to be bound
by all the Official Rules of this sweepstakes. The prizewinners will be
required to sign and return an affidavit or declaration of
eligibility, liability release, and, where lawful, a publicity
consent within thirty (30) days following attempted notification.
Awards presentations for the Grand Prize winners are mandatory and will
be at a designated location, time and date, by the sponsor. Sponsor is not responsible for and shall not be liable for late,
lost, misdirected or unsuccessful efforts to notify winner.
9. TERMS. By participating,
Sweepstakes entrants agree to abide by the terms of these Official
Rules, which are final on all matters pertaining to the
Sweepstakes. Sponsor reserves the right, in its sole discretion,
to adjust the dates or cancel this promotion. Sponsor, its parent
company, affiliates, and subsidiaries (advertising, promotion, and
fulfillment agencies), are not responsible for and shall not be
liable for: (i) late, lost, delayed, illegible, damaged,
misdirected, incomplete, or unintelligible entries; or (ii)
telephone, electronic, hardware or software program, network,
Internet, or computer malfunctions, failures, or difficulties of
any kind; (iii) failed, incomplete, garbled, or delayed computer
transmissions; (iv) any condition caused by events beyond the
control of the Sponsor that may cause the Sweepstakes to be
disrupted or corrupted; (v) any injuries, losses, or damages of
any kind arising in connection with or as a result of the prize,
or acceptance, possession, or use of the prize, or from
participation in the Sweepstakes or (vi) any printing or
typographical errors in any materials associated with the
Sweepstakes. Sponsor reserves the right, in its sole discretion,
to suspend or cancel the Sweepstakes at any time if a computer
virus, bug, or other technical problem corrupts the
administration, security, of the Sweepstakes.
10. GENERAL RELEASE. By
accepting a prize and entering this contest, participant agrees to release and hold harmless
sponsor and its parent company, subsidiaries, affiliates,
directors, officers, employees and agencies (collectively, the
"Released Parties") from any liability whatsoever, and
waive any and all causes of action, for any claims, costs,
injuries, losses or damages of any kind arising out of or in
connection with the Sweepstakes or acceptance, possession, or use
of any prize (including, without limitation, claims, costs,
injuries, losses or damages related to personal injuries, death,
damage to or destruction of property, rights of publicity or
privacy, defamation or portrayal in a false light, whether
intentional or unintentional), whether under a theory of contract,
tort (including negligence), warranty or other theory.
11. CONDUCT. Partnership
Marketing reserves the right at its sole discretion to disqualify
any unauthorized individual or anyone who tampers with the
operation of the Sweepstakes or web site or, to be acting in
violation of the Official Rules. Any person found tampering with
or abusing any aspect of this game, as solely determined by the
judges, will be disqualified. If disqualified for any of the above
abuses sponsor reserves right to terminate entrant's eligibility
to participate in game.
12. OFFICIAL RULES/WINNERS LIST.
Will be posted at www.MilitaryPartners.com throughout the
Sweepstakes. A Winners List and a copy of these Official Rules may
be obtained at www.MilitaryPartners.com web site weekly under
Military Partners’ Winners List starting on 15 May 2009 until
15 Jan 2010 or by sending a self-addressed stamped envelope to
Partnership Marketing, 4466 W. Pine Blvd, Suite 24-C, St. Louis,
Missouri, 63108.
